With the goal of complying with the existing law and ensuring security and confidence in all its users, we inform you, that in accordance with Law 34/2002 on Information Company and Electronic Commerce Services, that this website is the property of the Fundació Privada Elisava Escola Universitària (hereinafter ELISAVA) with NIF no. G-632102105 and located in La Rambla, 30-32, 08002, Barcelona and Registered in the Registry of Universities, Centres and Titles (RUCT) with code 08070210 through the Decree published in the Official Gazette of the Generalitat de Catalunya on 07/08/1995.

USER access to our website is free and is conditional on first reading and fully and expressly accepting, without reservations, these GENERAL CONDITIONS OF USE valid at the time of access, which we would ask you to read carefully. When using our website, its contents and services, the USER expressly accepts and is subject to its general conditions of use. If the user does not agree with these conditions of use, he or she must refrain from using this website or carrying out operations with it.

A. Intellectual Property

All content, texts, images and source codes are property of ELISAVA or of third parts, from whom rights of use have been acquired, and they are protected by Intellectual and Industrial Property rights.

The user only has the right to use them privately, on a not-for-profit basis, and requires the express authorisation in order to alter, reproduce, use or distribute them or any rights belonging to their holder.

ELISAVA is a registered trademark and the reproduction, imitation, use or insertion of these trademarks is prohibited without due authorisation from us.

The establishment of links to our website does not confer any rights over it. In addition, simply establishing a link to our website gives no rights to claim the status of collaborator or partner.

The partial or total imitation of our website is absolutely prohibited.


B. Access Conditions

Access to our website is free and does not require prior subscription or registration. However, specific services such as access to the Virtual Campus are of restricted access only available to specific users and require a prior registration and identification process through passwords. These services will be duly identified on the Website.

Sending personal data involves the USER’s express acceptance of our privacy policy.

Users must access our website in good faith and in accordance with the rules of public order and these General Conditions of Use. Access to our website takes place under the exclusive responsibility of the user, who will, under all circumstances, be liable for damages and losses caused to third parties or to ourselves.

Users are expressly prohibited from using or obtaining the services, products and content offered on this website by procedures other than those stipulated in these usage conditions and, as appropriate, in the specific conditions regulating the acquisition of certain products.

Bearing in mind the impossibility of controlling the information, content and services contained on other websites that may be accessed via the links provided on our website, we inform you that ELISAVA, accepts no liability for damages and losses of any kind that may derive from the use of these websites beyond the control of our company by users.

ELISAVA reserves the right to unilaterally remove any USER who the organisation understands has breached the conditions governing the use of our website without prior notice. In such cases, the USER shall have no right to make any claim. ELISAVA reserves the right to take the appropriate legal action against those breaching these general conditions of use. The USER accepts that failure to take such action does not constitute a formal waiver of it, and it remains a possibility until the deadline for legal action concerning such offences has passed.


C. Privacy Policy

Confidentiality and security are basic values for ELISAVA and, as a result, we are committed to guaranteeing the user’s privacy at all times and to not collecting unnecessary information about Users.

In accordance with the Personal Data Protection Act 15/1999 (LOPD) and Royal Decree 1720/2007 developing the LOPD, we inform you that the use of certain services on our website requires you to provide us with particular personal data using registration forms or by sending e-mail messages and that this is processed and incorporated in our files of ELISAVA, which owns and is responsible for the files. This sending of personal data constitutes express consent to its processing and incorporation in our files, although this may be revoked without retroactive effects.

We also inform you that all our files are legally entered in the Catalan Data Protection Authority’s General Registry of Personal Data and that, in order to safeguard the security of your personal data, the technical and organisational security measures required by Royal Decree 1720/2007 governing the regulation of security measures for files containing personal data will be applied.

In general, children under 14 are prohibited from providing personal data without the consent of their parents or legal guardians.

ELISAVA, reserves the right to decide whether or not to incorporate your personal data in its files. The user is solely responsible for any direct or indirect loss or damage caused to us or to any third party by filling in the forms with false, inaccurate, incomplete or out-of-date data or with data from third parties.

 

What data we request and for what purpose

The data we ask for is appropriate, relevant and strictly necessary for the purpose for which it is collected and you are under no circumstances obliged to provide us with it. However, the fields on the forms must be filled in to achieve the purpose of your application.

On different pages of our website we make e-mail addresses available so that you can ask us about any kind of information, clarification or doubts. If you include personal data in your e-mail, or your address contains personal data, you authorise us to incorporate them in our corresponding files.

We also inform you that in the case of receiving your curriculum vitae through e-mail, your data will be incorporated to our Human Resources files with the purpose of considering them in the case that present or future personnel selection processes take place.

In all these cases your data will be incorporated to a “MANAGEMENT” file. Acceptance of the present privacy policies implies the user’s consent to receive our business information related with our activity, including by electronic means, as long as you do not indicate the opposite in an e-mail to elisava@elisava.net

Rights to access, correct, cancel and challenge your personal data

You may exercise your rights of access, correction, cancellation and challenge at any time, under the terms legally established, by writing to the following address: ELISAVA - Personal Data Manager – La Rambla, 30-32, 08002, Barcelona.

We consider that if you do not expressly cancel your personal data in our files you remain interested in having the data included there for as long as we consider it appropriate and while it is useful for the purpose for which it was obtained.

 

Communication of data

We inform you that your data is handled with maximum confidentiality and is only used internally for the purposes indicated. We therefore do not transfer or communicate your data to any third party unless expressly authorised to do so by the user in legally established cases.

 

Security of your personal data

In order to safeguard the security of your personal data, we inform you that we have adopted all technical and organisational measures necessary to ensure the security of the personal data provided from alteration, loss and unauthorised processing or access, as required by Royal Decree 1720/2007 governing the regulation of security measures for files containing personal data.

ELISAVA uses information safety techniques which are generally accepted in the industry, such as firewalls, access control measures and cryptographic mechanisms, with the objective of avoiding unauthorised access to personal data. In order to achieve these purposes, the user/client accepts the provider’s data collection for the corresponding validation of the access control.
Any contracting process or any process that involves the information of personal data (name, bank details, addresses…) will always be transmitted through a safe communication protocol (HTTPS://) to ensure that no third parties have access to the information transmitted electronically.

 

Updating your data

To ensure that your personal data is up to date, it is important that you always inform us when there has been any change to it. If you do not, we cannot be answerable for its accuracy.

 

Cookies

The cookies are brief pieces of information that are sent and stored in the hard drive of the computer of the user through his or her browser when he or she visits a website. Bearing in mind that the main means of communication between ELISAVA and the USER is via the e-mail address provided, we inform you that we will use this medium for all communications with USERS, including commercial information or informative notes related to the purposes of our website and, as a result, in accordance with article 21 of the Information Society Services and E-Commerce Act, which prohibits the sending of commercial communication by e-mail if it has not expressly been authorised in advance by its recipients, we inform you that acceptance of these conditions of use involves express authorisation for sending you our commercial, advertising and promotional mailing. However, if you do not wish to receive our commercial communications by e-mail, you can refuse them at the address indicated above or in every message we send you.

We will accept no responsibility for privacy policy concerning any personal data provided to third parties using the links available on our website.

D. Liabilities

By making this website available to users we want to offer them a quality service, using maximum diligence in providing the services and in the technological means used. However, we will not be liable for the presence of viruses and other elements that may damage the user’s computer system in any way.
